Need someone to act on your behalf in China while you're abroad? A power of attorney (POA) allows you to authorize another person to handle legal, business, or personal matters for you. Here's how to create one that's valid in China.
When You Need a POA
- Selling property in China
- Managing business affairs
- Handling inheritance matters
- Court representation
- Banking transactions
- Government filings
Types of Power of Attorney
General POA
Broad authority for multiple matters:
- Wide scope of actions
- Higher risk if misused
- Less commonly accepted in China
Special/Limited POA
Authority for specific matters:
- Defined scope and duration
- More commonly accepted
- Recommended for most situations
Recommendation: Use a specific POA that clearly defines what the agent can do. Chinese authorities are often reluctant to accept broad general POAs.
Creating a Valid POA for China
If You're Outside China
- Draft the POA - Include specific powers, agent details, and duration
- Notarize - Have it notarized in your country
- Authenticate - Get authentication from Chinese embassy/consulate
- Translate - Have it translated into Chinese
If You're in China
Simpler process:
- Go to a Chinese notary office
- Bring passport and relevant documents
- Notary will prepare and notarize the POA
Authentication Process
For US Documents
- Notarize by US notary public
- State Secretary of State authentication
- US Department of State authentication
- Chinese embassy/consulate authentication
For Hague Convention Countries
Note: China is NOT a Hague Apostille Convention member, so apostilles are not accepted. Full authentication chain is required.
